Fremont Street, Stockton <br /> Dear Mr. Sasson; <br /> On June 15, 1995, we submitted a workplan to your office for <br /> additional soil & groundwater investigative work on the above <br /> site. We have just received your August 1, 1995 response, in <br /> which you state that the work must commence by August 15 in order <br /> to remain in compliance with Article 11 . <br /> We have been soliciting bid proposals for performing the task, <br /> and understand that our client has obtained the necessary permits <br /> from the City of Stockton. However, we have not submitted the <br /> required documents to the Cleanup Fund staff for pre-approval <br /> since one of the items needed is written approval of the workplan <br /> by the lead agency. We have not submitted the required drilling <br /> permit application pending approval of the Fund staff, since they <br /> may not allow all of the costs we anticipate the project will <br /> accrue. <br /> We will diligently proceed with obtaining Fund approval & <br /> securing the necessary permits . However, it is doubtful if the <br /> work can be commenced by the 15th. There are only two firms in <br /> the area that have the equipment to do the work, and the avail- <br /> ability of that equipment is beyond our control . <br /> We realize that the Site Mitigation Unit staff has a heavy <br /> workload, but so do we. We believe that requiring us to do the <br /> work in less than two weeks but taking six to respond to our <br /> workplan is unreasonable .
