INTERPRETATION OF SAN JOAQUIN USE PERMIT NO. 93-79 In 1993 , the Board of Supervisors approved Use Permit No. 93-09 for an open air mall subject to conditions of approval . The landowner has applied for an amendment to the Development title Table 9-505. 2 , Uses in Industrial Zone, to allow outdoor entertainment in the I-L zone. The purpose of this reeuest is to confirm that the existing use permit includes the right to provide outdoor entertainment at the Open Air Mall, subject to certain notifications requirements to public safety agencies . The landowner intends to provide occasional outdoor entertainment, such as bands, with a separate admission. In reviewing this matter, the Board of Supervisors make the following findings and interpretations of Use Permit No. 93-09 : 1 . In anmrovina Use Permit No. 93-09, the Board of Supervisors approved an open air mall and related uses. One of these uses is occasional live entertainment subject to a separate admission; 2 . In instances where the landowner intends to provide live entertainment subject to a separate admission, the landowner is recruired to provide the San Joaquin County Sheriff's Department and the San Joaquin County Emergency Management Service Demartment with at least ten (10) days advanced notice; 3 . This interpretation of Use Permit 93-09 is incorporated by reference to the terms and conditions of the use permit; and, 4 . Since Use Permit 93-09 already permits occasional live entertainment subject to a separate_ admission, then there_ is no need for the rea_uested amendment to the Development t_t_e, and the application is denied.
