• �rner Winery -3- 16 November 1984 <br /> RECOMMENDATIONS AND CONCLUSIONS <br /> Due to the many odor complaints and design problems discussed <br /> above , Turner is in threatened violation of Effluent Limitation <br /> 8. 2 , and Provision D. I . which state : <br /> 11B . 2 . Wastes discharged to land shall not cause degradation <br /> of any water supply. " <br /> "D. 1 . Neither the discharge nor its treatment shall cause a <br /> pollution or nuisance as defined in Section 13050 of the <br /> California Water Code" . <br /> Since Turner has not submitted any monitoring reports since <br /> January 1983 they are also in violation of Provision D. 3 . which <br /> states : <br /> "D. 3 . The discharger shall comply with the Monitoring and <br /> Reporting Program No . 80-055 and the General Provisions for <br /> Monitoring and Reporting as specified by the Executive <br /> Officer. " <br /> To resolve these problems Turner should prepare , and submit for <br /> Board review, a technical design plan for treating, handling, and <br /> disposing of all wastes generated at the facility. This plan <br /> should also include a time schedule for all proposed actions. <br /> When this plan is received, the Board can then revise the existing <br /> Waste Discharge Requirements to reflect any changes if necessary. <br /> Additionally , we will revise the existing Monitoring Program <br /> since it is presently insufficient . Since monitoring should <br /> reflect operations at the site , revision of the Monitoring <br /> Program should be postponed until the technical plan is received <br /> and the Requirements revised accordingly. <br /> INSPECTION SUMMARY <br /> Turner is in violation of Provision D. 3 . and threatened violation <br /> of Effluent Limitation B.2 . and Provision D.
