Weber Avenue <br /> Stockton, CA 95201-0388 <br /> Subject: Response to Tosco Refining Company, Stockton Terminal <br /> Notice of Hazardous Waste Violation <br /> Dear Mr. McClellon: <br /> This letter is being provided in response to the violation notice received pursuant to your <br /> inspection of the Tosco Refining Company's Stockton Terminal on December 4, 1996. The <br /> violation notice stated that the terminal was not in compliance with California hazardous waste <br /> regulations, specifically California Code of Regulations (CCR) Section 66268.7(a)(5). This <br /> section requires that generator knowledge or analytical testing be used to determine if the waste <br /> is restricted from land disposal and that all supporting data used to make that determination be <br /> kept on site. <br /> Past shipments of hydrocarbon and water mixtures were characterized as hazardous waste <br /> using generator knowledge and previous analytical data which is currently on file at the terminal, <br /> as required by CCR section 66268.7(x)(5). <br /> It is our understanding that we are meeting the requirements of the California hazardous <br /> waste laws and regulations.
