'Weber Avenue
Stockton, CA 95201-0388
Subject: Response to Tosco Refining Company, Stockton Terminal
Notice of Hazardous Waste Violation
Dear Mr. McClellon:
This letter is being provided in response to the violation notice received pursuant to your
inspection of the Tosco Refining Company's Stockton Terminal on December 4, 1996. The
violation notice stated that the terminal was not in compliance with California hazardous waste
regulations, specifically California Code of Regulations (CCR) Section 66268.7(a)(5). This
section requires that generator knowledge or analytical testing be used to determine if the waste
is restricted from land disposal and that all supporting data used to make that determination be
kept on site.
Past shipments of hydrocarbon and water mixtures were characterized as hazardous waste
using generator knowledge and previous analytical data which is currently on file at the terminal,
as required by CCR section 66268-7(a)(5).
It is our understanding that we are meeting the requirements of the California hazardous
waste laws and regulations. If you wish to discuss this issue or have any questions, please call
me at(510)370-3223.
Sincerely,
David A. Graser
Senior Environmental Engineer
DAG!
