Conoco Phillips Company -2- April 19, 2004 <br /> Page seven(7)of your claim application was a copy and isn't signed by the same person(Mike Bryan or <br /> Sterling Hundley) as indicated on the Power of Attorney form(dated 7/16/03) that Conoco Phillips <br /> Company submitted to the Fund. The Claimant must provide an "original signed" Verification and <br /> Signature Page including signatory's title as related to the claimant(see enclosed Verification and <br /> Signature page). <br /> The map you submitted includes several USTs and ASTs. On the enclosed copy,please identify the <br /> eligible USTs that you owned or operated and in which you are requesting cleanup costs from the Fund. <br /> Note that an eligible tank must be a petroleum UST as defined in section 25281(x)of the H&SC and one <br /> for which a permit is required pursuant to section 25284 of the H&SC. <br /> Copy of the first letter from the local regulatory agency naming you a responsible party and directing you <br /> to cleanup the contamination at the subject site. <br /> Claimant is required to provide documentation that all current and prior UST fees due on or after January <br /> 1, 1991 imposed by Section 25299.41 of the Health and Safety Code have been paid. If any of the USTs <br /> owned or operated had product placed in them on or after January 1, 1991, attach the most recent copy of <br /> the UST Fee Return Form filed with the State Board of Equalization(BOE)with proof of payment(copy <br /> of canceled check). <br /> Claimant must provide the following for the purchase of the site: <br /> 1. Purchase Offer <br /> 2. Purchase Agreement(final) <br /> 3. Appraisal Report <br /> 4. Escrow Instructions <br /> The Underground Tank Regulations excludes certain underground tanks from participation in the Fund. <br /> Please refer to the enclosed copy of Section 2621. Exemptions to the Underground Tank Regulations <br /> from the California Code Regs. Title 23, Division 3, Chapter 16, Underground Tank Regulations. In <br /> addition, the Fund does not reimburse cleanup costs associated with Above Ground Tanks(ASTs). <br /> 1. Did you ever operate the USTs or were you just the UST owner. On page three(3)of your <br /> application you indicated that you owned and operated the USTs from 1994 through 1998. <br /> However, the permits to operate during that time frame were issued to BP. Please clarify. <br /> 2. The Unauthorized Release appears to have occurred in 1987 and there was a closure April 28, <br /> 2002. Provide a copy of the closure letter. <br /> 3. Even though it appears there was closure on April 28, 2002, corrective action continues. <br /> What was the bas for the closure? Please clarify. <br /> 4. Your attachment to page(2)of the claim application shows a release in 1987, 1989, 1993, <br /> and 1994. Besides the release of 1987,were any of the other releases from an eligible UST? <br /> If so, were UST Unauthorized Release (LEAK) Contamination Site Reports filed for each of <br /> these releases? If so,provide copies or clarify. <br /> 5. It is noted that the local regulatory agency's letter of January 3,2001 (RWQCB)has named <br /> BP Oil Company,Tosco Refining Company, and ST Services collectively responsible parties <br /> and that all have operated this terminal. How is the cleanup costs being handled? Is there a <br /> cost sharing agreement? If so,please provide a copy of the agreement. Or clarify. <br /> 6.
