JUL id 'y4 10 08HN VHLLEr WHOLESHLE p 3/3 <br /> UST LUFT LETTER <br /> Page 2 <br /> ' Before receiving a PHS/EHD corrective action directive and in order to receive <br /> the SWRCH Cleanup Fund Letter of Commitment, you must make application to the <br /> State of California water Resources Control Board's (SWRCH) "Petroleum <br /> Underground Storage Tank Cleanup Fund" (Fund) . An application package for the <br /> ' Fund has been provided. <br /> The Fund was created pursuant to Chapter 6.75 of the California Health and <br /> safety Code to help eligible owners and operators of petroleum underground <br /> ' storage tanks tot <br /> 1. Meet federal requirements to demonstrate financial responsibility, <br /> 2. obtain reimbursement for costs of the cleanup of unauthorized <br /> ' releases of petroleum from USTe; and <br /> 3. Obtain reimbursement for damages awarded to third parties who are <br /> in3ured by petroleum releases. <br /> ' The maximum amount available from the Fund is $990,000 per occurrence. <br /> Claimants are responsible for the first $10,000 of eligible costs. <br /> Applications must be submitted to the 6WRcB Cleanup Fund to undergo <br /> ' eligibility ranking for funding in the 1996-95 state fiscal budget year, All <br /> subsurface investigations and remedial actions must be performed under a <br /> workplan approved by PHS/EHD. <br /> The Fund does not cover the costa incurred for the removal, repair, retrofit, <br /> or installation of UST9.
