s %MI
t
Marge Comer -3-
March 28, 2008
Claim No. 19097
• Before submitting the application to the Fund, the claimant has paid all UST
storage fees, interest, and penalties imposed pursuant to Article 5 (commencing
with Section 25299.40) and Part 26 (commencing with Section 50101) of Division
2 of the Revenue and Taxation Code for the UST that is the subject of the claim.
Claimants who qualify for the permit waiver under AB 1437 must pay a higher
deductible on their claim, depending upon the date that the claimant complied with UST
permitting or closure requirements. Claimants who comply on or before December 22,
1998, must pay twice the amount of deductible that would otherwise apply to the claim,
and claimants who comply after December 22, 1998, must pay a deductible that is four
times the amount that would otherwise apply to the claim.
I have enclosed information regarding AB 1437 for your review. Please review the
enclosed information and if you feel that your situation meets the requirements of
AB 1437, you may re-apply to the Fund. The new application is located at
http://www.waterboards.ca.gov/cwphome/ustcf.
Since you appear to meet the requirements under AB 1437, you must complete
the enclosed permit waiver form and submit a new claim application. Any
previous applicable backup documentation submitted with this claim (number
19097), will be incorporated into the new claim application; therefore duplication
is not necessary, except for forms that require a current datelsignature (i.e.,
updated financial responsibility documents). Additionally, the review also
revealed that Marge Comer has recently passed away. When you submit your
new claim application, please indicate who the claimant should be (trust or
estate), and submit all necessary documentation such as death certificate, trust
or estate documents, will, letters testamentary, etc.
Appeal Process
This represents a Staff Decision. If you disagree with this decision, you may appeal to
the Fund Manager pursuant to Section 2814 of the Petroleum Underground Storage
Tank Cleanup Fund Regulations.
If you would like review of the decision by the Fund Manager, please submit your
request along with any additional documentation to:
Ronald M. Duff, Fund Manager, Claim #019091
Underground Storage Tank Cleanup Fund
State Water Resources Control-Board
Division of Financial Assistance
P.O. Box 944212
Sacramento, CA 94244-2120
California En vironmentai Protection Agency
(5 Recycled Paper
