(ATC) was <br /> approved for implementation . SJC/EHD further informed you in correspondence dated <br /> April 10 , 2006 that the deadline for implementation of the work plan was June 2, 2006 , <br /> and for submittal of a report of findings was August 2, 2006. In addition, ATC was to <br /> have submitted an analysis of their comparison of your site with the contaminated site at <br /> 2050 Fremont Street no later than May 5, 2006, <br /> On May 18, 2006 ATC stated they would submit a drilling permit application and drilling <br /> schedule by May 31 , 2006 , and the comparison report of the two sites by July 7, 2006. <br /> A permit application was submitted , but not until June 26, 2006 ; permit #47205 was <br /> issued the same day. Unfortunately, you have not proceeded in good faith with carrying <br /> out the prescribed scope of work, and ATC has never submitted their analysis of <br /> comparing your site with the site at 2050 Fremont Street. <br /> This site is currently out of compliance with regulatory directives for failing to proceed <br /> with the required investigation . Remaining in compliance with regulatory directives is a <br /> requirement of eligibility to the State Water Resources Control Board Cleanup Fund <br /> (SWRCB-CUF). <br /> You are directed to complete the following : <br /> 1 . Inform SJC/EHD within 14 days of the date of this letter that fieldwork has been <br /> scheduled to implement the approved work plan . <br /> 2. Complete the fieldwork no later than October 20, 2006 . <br /> 3. Submit a Report of Findings detailing the results of the fieldwork no later than <br /> December 20, 2006 , <br /> 4. Submit the comparative analysis of the two contaminated sites to SJC/EHD <br /> within 14 days of the date of this letter. <br />
