Freemont Street <br /> Dear Ms. Lukaszewicz: <br /> On behalf of my client, Scott Damouny, I am in receipt of your letter to Mr. <br /> Damouny requesting access to his Property to install wells as required by <br /> Environmental Health. My client does not object to providing you with access <br /> assuming we can come to an agreement on the terms of your access. <br /> I would propose that you or your client prepare an agreement which defines the <br /> terms of the access. The agreement must include the following provisions. <br /> 1. All work performed shall be directed by San Joaquin County <br /> Environmental Health Department("Department") Staff. All work <br /> directed by staff must be in writing and delivered to Mr. Damouny. <br /> 2. No work shall be conducted on the Property outside the work directed by <br /> the Department. <br /> 3. The work will not unreasonably interfere with the normal operation of the <br /> Property. The property is occupied by a restaurant. To avoid interference <br /> with the business, all work should be completed during the morning <br /> hours. <br /> 4. The work will be performed by a licensed contractor at the sole expense <br /> of Shell. <br /> 385512-1 <br />
