The following is an itemized list of permit by rule tiered permit violations that have <br /> not been addressed for PREMIER FINISHING as of June 27 , 2019 . <br /> Open violations from January 15 , 2019 inspection <br /> Violation #109 - Failed to conduct and submit a phase one environmental assessment within one year. <br /> The facility could not provide a legible , signed Phase 1 Environmental Assessment during the inspection. <br /> A phase I environmental assessment means a preliminary site assessment based on reasonably available <br /> knowledge of the facility , including , but not limited to , historical use of the property , prior releases , visual and other <br /> surveys , records , consultant reports , and regulatory agency correspondence . <br /> The phase 1 environmental assessment shall consist of completion of the Phase 1 Environmental Assessment <br /> Checklist developed by DTSC pursuant to HSC Section 25200 . 14 . <br /> A phase I environmental assessment shall be certified by the facility owner or operator or by the generator, or by <br /> their designee , or by a certified professional engineer, or a geologist, or an environmental assessor. <br /> Provide a copy of the complete , legible , certified , signed Phase 1 Environmental Assessment to San Joaquin <br /> County Environmental Health Department ( EHD ) and keep the original at the facility. <br /> Violation #113 - Failed to submit correct PBR information in CERS . <br /> The Permit by Rule ( PBR) section of the Waste and Treatment Process Combinations is incomplete in the <br /> California Environmental Reporting System (CERS ) . Section 2 indicates that Aqueous Wastes containing metals is <br /> treated by " precipitation " . The process also uses " Phase Separation by Filter" by using the filter press and <br /> " Evaporation " by sludge heating . Indicate "yes" in CERS for the " Phase Separation by Filter" and " Evaporation " <br /> processes. <br /> The Treatment Unit Identification and Details in CERS are incomplete. Verify that the Monthly Treatment Volume is <br /> correct. Currently the volume of 30 , 000 gallons appears to include all waste water discharged to the City of <br /> Stockton sewer system . Only report the volume of hazardous waste water treated by the hazardous waste <br /> treatment system ( precipitation , filter press and evaporation process) . <br /> Expand the Treatment Process Description narrative to include the precipitation , filter press and evaporation <br /> processes. Include the number of days a year the FTU is in operation . <br /> In CERS , the Property Owner notification section states "exempt" , and that the business owner is the property <br /> owner. According to County property records for Parcel ID 17726035 (this address) , San Joaquin County is the <br /> property owner. Comply with Title 22 California Code of Regulations section 67450 . 2 ( b ) (3 ) (C ) , and notify the <br /> property owner that the Fixed Treatment Unit ( FTU) is in operation . Upload the notification document to CERS . <br /> Violation #213 - Failed to prepare a closure plan , notify the CUPA of closure or submit a closure <br /> certification . <br /> OBSERVATION According to the EHD inspection report dated April 26 , 2017 , the hexavalent chromium treatment <br /> unit was closed in early 2016 . <br /> The TTU owner or operator shall remain in compliance with the applicable requirements of this section until the <br /> owner or operator submits to the Department a certification signed by the owner or operator and by an independent , <br /> professional engineer registered in California , that closure has been completed in accordance with the closure plan <br /> and that the closure plan meets or exceeds the applicable requirements of this chapter. <br /> CORRECTIVE ACTION : Provide to the EHD , a certification signed by the owner or operator and by an independent, <br /> professional engineer registered in California , that closure has been completed in accordance with the closure plan <br /> and that the closure plan meets or exceeds the applicable requirements of this chapter . <br /> Page 1 of 3 <br />
