Pursuant to the requirements to complete the <br /> certification,below are statements relating to each of the Class II violations (108 &206). In addition, we <br /> have attached a copy of a letter authored by NuStar's Designated Operator. <br /> 108—Secondary containment inspection as required under SB989 was performed late due to a number of <br /> factors, most notably an inefficiency in our regulatory tracking calendar; this has since been fixed to <br /> indicate and notify the Terminal in sufficient time to schedule a qualified contractor to perform the <br /> testing. Additionally, our contractor(Designated Operator)had some personal difficulty at the time <br /> which affected his abilities/availability(personal letter from Mr. Dan McIlrath(Valley Underground Tank <br /> attached)), including our subcontractor not having sufficient certification for confined space entry. <br /> NuStar holds contractors to the highest health, safety, and environmental standards with respect to safe <br /> operating practices. <br /> A copy of the Secondary Containment Testing Report Form was transmitted electronically to your <br /> attention on June 20, 2012, and is included as an attachment to this transmittal. <br /> 204—NuStar's Designated Operator has and will continue to check and note the correct dates and <br /> information is included on each monthly monitoring as required; paperwork is now up to date.
