To: Dan Thomas June o5, 2012 <br /> Nustar Energy <br /> Reg: Health dept Annual Inspection/Violation <br /> Dan, <br /> Even though I did have the proper previous date in the book of Feb. 2009, I will take full <br /> responsibility for the test getting done late,I do feel fortunate that I did catch it prior to <br /> the county and getting it scheduled rather than the County coming in and catching that it <br /> had not been done. <br /> This was an over-sight on my part due to several reasons which we have spoke in person <br /> together but want to address it on paper for you for any reasons you may need. <br /> We both have had many conversations and I think it showed at times that I was a little <br /> pre-occupied and confused as this was at the time my wife was in Stanford Medical <br /> center in the ICU waiting for the out come of her liver disease not knowing which way <br /> the outcome would be,which we were very lucky and blessed that she did recieve the <br /> transplant, I was driving back and forth to much,and was not paying good attention to my <br /> other customers,this went on for several months. <br /> At the same time I was trusting our tank testing company to do the test, and I trusted them <br /> and did not follow up good with them as to the status. Then we find out after they get on <br /> sight that they are not allowed to do this test anymore due to a change in one of the rules <br /> on going into the sump,at which time we then talked and you were able to contact <br /> another company able to do the work. And at the same time we were trying to make <br /> arrangements for the annual tests which was due close to the same time. <br /> I am by no way making excuses for my oversight,on this test which is due every three <br /> years. This is the first time anything like this has happened since I took on this job for <br /> Nustar when the County put this law into effect. I do appoligize for any hardships I have <br /> caused and have made some changes to my paper work date tracking and do not see this <br /> ever happening again. <br /> I do sincerely appolligize again and look forward to continuing our bussiness together and <br /> bring my work up to higher level of quality <br /> Dan MclLrath <br /> Valley Underground Tank <br /> Q Oil �1CS <br />
