1 include emergency response plans and procedures in the event of a reportable release or threatened <br /> 2 release of a hazardous material, including but not limited to the following: <br /> 3 1. Irnnmediate notification to the San Joaquin County Office of Emergency <br /> 4 Services and to the appropriate local emergency rescue personnel; <br /> 5 2. Procedures for the mitigation of a release or threatened release to minimize <br /> 6 any potential harm or damage to persons,properly,or the environment-, <br /> 7 3. Evacuation plans and procedures, including immediate notice, for the <br /> 8 business site. <br /> 9 c. Violating Health and Safety Code section 25504(c),failing to train all new <br /> 10 employees and annual training, including refresher courses, for all employees in safety procedures in <br /> 11 the event of a release or threatened release of a hazardous material,including,but not limited to, <br /> 12 familiarity with the plans and procedures specified in Health and Safety Code section 25504(b); <br /> 13 d. Violating of Health and Safety Code section 25505,failing to submit a business <br /> 14 plan for emergency response to a release or threatened release of hazardous material for the year <br /> 15 2008/2009 for 420 W.Kettleman Lane,Lodi, CA,to the San Joaquin County Office of Emergency <br /> 16 Services. Further,it is alleged that said violation was knowingly committed after reasonable notice; <br /> 17 and <br /> 18 e.-Violating of Health and Safety Code section 25505(e)(2),failing to annually <br /> 19 submit a form,provided by the San Joaquin County Office of Emergency Services,that certifies that <br /> 20 the handler has included,and maintains as current,in the business plan,all other information <br /> 21 required by Health and Safety section 25504. <br /> 22 6. Defendant with actual or constructive knowledge of this Injunction,only in so far as they <br /> 23 are doing business in the State of Califorriia,in the course of Defendant's GASOLINE <br /> 24 SALES/NM-MART activities, are,pursuant to California Business and Professions Code section <br /> 25 17204,hereby permanently enjoined from: <br /> 26 a. Violating Health and Safety Code section 25181 et seq.,described in paragraph <br /> 27 3—3(i)above; <br /> 28 b. Violating Health and Safety Code section 25290 et seq.,described in paragraph <br /> -5- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
