i <br /> I effort to resolve any further penalty assessments or other relief pursuant to this paragraph without <br /> 2 judicial intervention. Defendant reserves all defenses in law and equity. <br /> 3 9. If all the conditions listed in paragraph 7 above are met,then three (3)years from the <br /> .4 filing date of this document;the stayed penalty shall be suspended permanently. <br /> 5 10. Defendant shall additionally pay to Plaintiff the sum of FOUR THOUSAND TWO <br /> 6 HUNDRED DOLLARS ($4,200.00) as partial recovery of the cost of investigation and suit incurred <br /> 7 by the SAN JOAQUN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. Said payment shall be due and pq able to the aforementioned <br /> 13 agency, and shall be delivered to the San Joaquin County Office of the District Attorney, <br /> 14 Environmental Prosecutions Unit, at time of signing. <br /> 15 12. This Judgment shall go into effect immediately upon entry hereof.
