Date Permit Issued: -� <br /> Additional Conditions of Encroachment Permit No. Ll�ll 2 <br /> 1. All discharge to the sewer system must comply with <br /> Article 2 Section 5-6. 201 "Prohibitions on <br /> Discharge" of the City of Tracy Municipal Code and to <br /> any applicable code or ordinances. <br /> 2 . The Permittee should provide the City a copy of the <br /> written permission obtained from private property <br /> owners for work done outside the City right of way. <br /> This encroachment permit covers work <br /> performed by the Permittee within the street right of <br /> way. <br /> 3 . The Permittee at his own expense shall restore disturbed <br /> underground utilities and structures or improvements to <br /> it' s original condition or in better form to the <br /> satisfaction of the City. Any damage, arising from or <br /> in consequence of the performance of the work to <br /> adjoining work, or to any other property, whether <br /> private or public, shall be repaired at once by the <br /> Permittee or upon the occurence of such damage. The <br /> Permittee shall obtain from the Owner of the damaged <br /> property, a release from his liability of such damage. <br /> The Permittee shall take immediate action to mitigate <br /> or correct any damages when in the opinion of the City <br /> ,.� these damages pose hazard to persons or property. <br /> 4 . The Permittee is required to take due precautionary <br /> measures to protect the utilities or stuctures existing <br /> on site. It shall be the Permittee' s responsibility to <br /> notify the Owner of the utilities or structures <br /> concerned before starting work. <br /> 5. The City and all of it' s officers and employees connected <br /> with the work, shall not be answerable or accountable <br /> in any manner for any loss, or damage to any of the <br /> materials or other things used or employed in <br /> performing the work; for injury, sickness, disease or <br /> death or for damage to property, resulting from any <br /> cause whatsoever, on account of the performance or <br /> character of the work. Consistent with California <br /> Civil Code, the Permittee shall assume the defense of, <br /> and indemnify, and hold harmless the City and all of <br /> it' s officers and employees connected with the work, <br /> from claims, suits, actions, losses and liability of <br /> every kind, nature and description, including, but not <br /> limited to attorney' s fees directly or indirectly <br /> arising out of, connected with or resulting from, the <br /> performance of the work, the failure to perform the <br />
