HWY #4, STOCKTON, CA 95206
During our in-depth review of San Joaquin County Environmental Health
Division (SJCEHD) files, we found that you never obtained or applied for a
permit to operate your underground storage tanks prior to January 1, 1990
as required by our program.
Further investigation showed that you qualify for a "permit waiver" . Under
the amended provisions of Section 25299 . 57 of the Health and Safety Code
(H&SC) , the State Board has granted a waiver for the permit requirement as
a condition for eligibility to the Fund. It is important to note that when
a claimant does not obtain the required permits by January 1, 1990, and the
State Board grants the permit waiver, the deductible is increased from
$10, 000 to $20, 000 (the claimant must pay the first $20, 000 of cleanup
costs before the Fund coverage begins) .
Our review also revealed that you have not yet performed any eligible
corrective action on your site. On August 30, 1994 , SJCEHD issued a
directive with a due date of November 1, 1994 . Please submit evidence of
compliance (i.e. copies of three bids and a signed contract) by November
ist and we will begin the process to issue a Letter of Commitment.
In addition, our tax review confirmed that you qualify as a Priority Class
B claimant.
If you have any questions, please contact Barbara Andersen at (916) 227-
4417 .
Sincerely,
g,al a
Barbara Andersen, SSA
Underground Storage Tank
Cleanup Fund Program
cc: San Joaquin County EHD
Attn: Diane Hinson
P.O.
