REPORT OF WASTE DISCHARGE AND EXEMPTION <br /> FROM CALIFORNIA CODE OF REGULATION, TITLE 27 BY UNDERGROUND DEEP <br /> INJECTION OF WASTEWATER, SAN JOAQUIN COUNTY <br /> On 2 February 2004, the Central Valley Regional Water Quality Control Board (Regional Board) <br /> received Kruger Foods, Inc. Report of Waste Discharge (ROWD) for their new vegetable processing <br /> facility off Highway 4, east of Stockton. This ROWD was submitted in response to the 16 December <br /> 2003 Notice of Violation,which indicated that without a permit the facility was illegally discharging <br /> their wastewater. The submitted ROWD is complete and complies with California Code of <br /> Regulations, Title 27 (Title 27). Staff has reviewed the ROWD and has the following comments: <br /> ■ The wastewater leaving the Kruger Foods, Inc. processing facility contains soluble constituents <br /> that exceed their water quality limit. For example, the total dissolved solids concentration of <br /> 29,000 mg/1 is 64 times greater than the agricultural limit of 450 mg/l. Therefore, under Section <br /> 13173(b) of the California Water Code, the wastewater must be managed as a designated <br /> waste; <br /> ■ Section 20210 of Title 27 states: designated waste, as defined in California Water Code <br /> /13173, shall be discharged only at Class I waste management units (for information regarding <br /> Class I Units, see Chapter 15, Division 3, Title 23 of this code) or at Class U waste <br /> management units which comply with the applicable SWRCB promulgated provisions of this <br /> subdivision and have been approved by the RWQCB for containment of the particular kind of <br /> waste to be discharged-, and <br /> • The ROWD states that all wastewater generated at the Kruger Foods, Inc. facility will be <br /> "disposed via subsurface injection under USEPA authority for the Class 1 Sousa No. 1 well". <br /> Under Section 20090(c) of Title 27, deep underground injection of wastewater qualifies the <br /> discharge for an exemption from Title 27 requirements. <br /> Kruger Foods, Inc. must realize that at any time for any reason this wastewater is discharged anywhere <br /> other than the injection well (i.e. SMS Briners surface impoundments) it will be considered a direct <br /> violation of the California Water Code, and staff will immediately recommend enforcement action be <br /> taken. <br /> California Environmental Protection Agency <br /> C- Recycled Paper <br />
