Presently, the wastewater that is generated is handled by SMS Briners which is
regulated under the Title 27 program at the Regional Board. SMS Briners operates an injection well to
dispose of wastewater and stormwater. During a recent inspection, violations of SMS Briners' Waste
Discharge Requirements (WDRs) were observed; those violations will be addressed by Title 27 regulatory
program staff.
In our 1 May 2001 meeting you described plans to provide treatment of the cherry processing wastewater
to allow land application of low strength wastewater. High strength wastewater will continue to be
pumped to the injection well operated by SMS Briners. As you are aware, cherry processing wastewater
contains chemicals that can degrade surface and groundwater quality; therefore, discharge of this
wastewater requires WDRs issued by the Regional Board. Depending on the level of treatment and the
resulting wastewater quality, California Cherry Briners' wastewater may be acceptable for land discharge.
To obtain WDRs, you must first submit a Report of Waste Discharge (RWD).
Consistent with California Water Code Section 13260, you are required to submit an RWD at least 120
days prior to discharging wastewater. Adoption of the WDRs can take longer than 120 days depending on
the completeness of the RWD.
An RWD consists of the Form 200 Application/Report of Waste Discharge General Information
(enclosed), a filing fee, and the answers to the Additional Questions. The RWD shall be prepared in a
technical report by a California Registered Engineer. The RWD, at a minimum, shall address the
Additional Questions; it shall also include any additional information required to explain the site specific
processes.
The filing fee is based on the threat and complexity of the discharge, as described in the enclosed filing
fee schedule. We have determined that this discharge is categorized as 2B, with a$1,200 annual fee.
California Environmental Protection Agency
pia Recycled Paper
The energy challenge facing California is real.
