CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> 11020 Sun Center Drive#200 Rancho Cordova,California 95827 <br /> PUBLIC HEARING <br /> for <br /> CONSIDERATION OF WASTE DISCHARGE REQUIREMENTS <br /> FOR <br /> CLOSURE, POST CLOSURE AND CORRECTIVE ACTION OF SURFACE <br /> IMPOUNDMENTS AT KRUGER FOODS, INC - <br /> SMS BRINERS VEGETABLE BRINING FACILITY <br /> SAN JOAQUIN COUNTY <br /> Kruger Foods, Inc. owns SMS Briners, Inc. that operates a vegetable brining facility near <br /> Farmington. The facility was previously regulated by Waste Discharge Requirements (WDRs) <br /> Order No. 92-053 in conformance with Title 27 California Code of Regulations,Division 2 (Title <br /> 27). The containment system consists of two surface impoundments that were constructed in <br /> 1975 with flexible membrane liners. The liners are in poor repair with numerous holes exposed <br /> to the surface,which do not comply with the prescriptive standards for Class 11 Surface <br /> Impoundments in Title 27. Monitoring of groundwater and the adjacent North Little Johns Creek <br /> indicates that the facility operations have impacted groundwater and surface water beneficial <br /> uses. This Order requires the following: it identifies a change in ownership; all discharges to the <br /> surface impoundments must cease forthwith; the surface impoundments must be clean closed by <br /> 31 October 2005; an investigation of the extent of the chloride contaminated groundwater; and <br /> to evaluate the effectiveness and update the corrective action program. <br /> A formal public hearing concerning this matter will be held during the Regional Board meeting <br /> that is scheduled for: <br /> DATE: 14/15 October 2004 <br /> TIME: 8:30 AM. <br /> PLACE: Regional Board Office <br /> 11020 Sun Center Dr., Ste. 200 <br /> Rancho Cordova, CA 95670-6114 <br /> The designated parties for this hearing are as follows: <br /> • Staff of Central Valley Regional Board <br /> • Kruger Foods, Inc. / SMS Briners,Inc. <br /> Only designated parties will have these rights: to call and examine witnesses; to introduce <br /> exhibits;to cross-examine opposing witnesses; to impeach any witness; and to rebut the evidence <br /> against him or her. All other persons wishing to testify or provide comments are interested <br /> persons and not designated parties. Such interested persons may request status as a designated <br /> party for purposes of this hearing by submitting such request in writing to the Board no later than <br /> 30 August 2004. The request must explain the basis for status as a designated party and in <br /> particular how the person is directly affected by the discharge. <br />
