Rehon <br /> Ware & Freidenrich <br /> 400 Hamilton Avenue <br /> Palo Alto, CA 94301 <br /> DIVIDEND DEVELOPMENT CORPORATION, 13170 GRANTLINE & BYRON ROADS, TRACY, SAN <br /> JOAQUIN COUNTY <br /> In response to your letter dated 8 July 1992, we want to reiterate the <br /> position of the Board regarding the soil and ground water contamination <br /> reported on the Dividend Development Company property in Tracy. <br /> Unacceptable concentrations of petroleum hydrocarbons have been documented to <br /> exist in the soils and in the ground water at the Dividend Development <br /> properties located along the Byron Road Railroad and Pipeline easement. We j <br /> formally approved remedial actions proposed for the North Property site <br /> remediation in a letter dated 5 November 1991 and strongly encourage the <br /> immediate removal and on-site treatment of all polluted soil to eliminate its <br /> continuing threat to water quality in the area. Additionally, ground water <br /> extraction and/or monitoring wells will be needed after soil removal and <br /> treatment and therefore development of this portion of Dividend Developments <br /> properties should be limited until cleanup is complete. <br /> i <br /> We are aware of numerous problems of this type along the pipelines in the <br /> Central Valley_however under current staffing and _funding_shortfalls,_we_ are_ al <br /> unable to take enforcement actions at this time.
