Information contained in a report entitled <br /> "Soil and Groundwater Investigation and Screening Health Risk Assessment of the Old <br /> Valley Pipeline Right-of-Way," dated September 1999 and prepared by Geomatrix <br /> Consultants, states soil and groundwater sampling was conducted at the Site. <br /> Sampling indicates the presence of petroleum hydrocarbon in soils and low levels of <br /> petroleum constituents including benzene, toluene, ethylbenzene, xylenes, and poly <br /> aromatic hydrocarbons detected in either soil or groundwater. <br /> 2.3 Physical Description. The Mansfield property consists of a 17-acre parcel <br /> located west of Southern Pacific Railway and Byron Road, and north of interstate 205. <br /> The parcel is occupied by a single residential home and is used for grazing cattle. The <br /> Chevron pipeline right-of-way runs along the southern border of the property. <br /> 2.4 Site History. From the early 1900's to the 1950's, the Old Valley Pipeline <br /> was used by Standard Oil Company (now Chevron) to transport heavy petroleum <br /> (crude oil) from Bakersfield to Richmond, California. The easement for the pipeline <br /> exists on the southern portion of the Mansfield's property. Pipes were typically buried <br /> four feet below grade and had the occasion to leak. While there is no exact incident of <br /> a release from the pipeline, residual contamination found in soils are likely associated <br /> with the pipeline and needs to be evaluated to determine if there exists a risk to public <br /> health or the environment prior to the construction of the proposed multi-family <br /> residential complex. <br /> III. AGREEMENT <br /> 3.0 IT IS HEREBY AGREED THAT DTSC will provide review and oversight of <br /> the response activities conducted by the Proponent in accordance with the Scope of <br /> Work contained in Exhibit C. The Proponent shall conduct the activities in the manner <br /> specified herein and in accordance with the schedule specified in Exhibit E. All work <br /> shall be performed consistent with H&SC section 25300 et seq., as amended; the <br /> National Contingency Plan (40 Code of Federal Regulations (CFR) Part 300), as <br /> amended; U.S. EPA and DTSC Superfund guidance documents regarding site <br /> investigation and remediation. <br /> 3.1 Scone of Work and DTSC Oversight. DTSC shall review and provide <br /> Proponent with written comments on all Propohent deliverables as described in <br /> Exhibit C (Scope of Work) and other documents applicable to the scope of the project. <br /> DTSC shall provide oversight of field activities, including sampling and remedial <br /> activities, a's appropriate. DTSC's completion of activities described above shall <br /> constitute DTSC's complete performance under this Agreement. <br /> 3.2 Additional Activities. Additional activities may be conducted and DTSC <br /> oversight provided by amendment to this Agreement or Exhibits hereto in,accordance <br /> with Paragraph 3.17. If DTSC expects additional oversight costs to be incurred related <br /> to these additional activities, it will provide an estimate of the additional oversight cost <br /> to the Proponent. <br /> 2 <br />
