Box 49027 <br /> San Jose, CA 95161-9027 <br /> SITE CLOSURE, ORCHARD SUPPLY HARDWARE, 8715 WEST GRANT LINE ROAD, TRACY, SAN <br /> JOAQUIN COUNTY <br /> Your report, dated 21 May 1991, contained a request for closure by your <br /> consultant, Clayton Environmental . In a letter to the Board, dated 16 July 1991 , <br /> San Joaquin County staff agreed that all appropriate remediation had been <br /> completed at this time and requested that Board staff review the site for <br /> closure. Board staff reviewed the file, and in a letter, dated 19 August 1991, <br /> requested additional information on the depth of the excavation, depth to ground <br /> water, and soil sample results. Your report, dated 16 October 1991 , describing <br /> the site conditions has been reviewed. <br /> Work completed to dated indicates that sufficient soil has been excavated and <br /> treated to eliminate a threat to ground water. In January 1991 , none of the <br /> three monitoring wells, MW1, MW2, and MW3B, contained detectable levels of <br /> hydrocarbons in ground water samples. <br /> Based on the information provided, Board staff has determined, and San Joaquin <br /> County Public Health Services staff concurs, that appropriate response actions <br /> have been completed, that acceptable remedial practices were implemented, and <br /> that, at this time, no further investigation, remedial or removal action, or <br /> monitoring is required at the Orchard Supply Hardware site, 8715 West Grant Line <br /> Road, Tracy. <br /> Nothing in this determination shall constitute or be construed as a satisfaction <br /> or release from liability for any conditions or claims arising as a result of <br /> past, current, or future operations at this location. Nothing in this <br /> determination is intended or shall be construed to limit the rights of any <br /> parties with respect to claims arising out of or relating to deposit or disposal <br /> at any other location of substances removed from the site. Nothing in this <br /> determination is intended or shall be construed to limit or preclude the Board <br /> or any other agency from taking any further enforcement actions. <br /> This letter does not relieve the tank owner of any responsibilities mandated <br /> under the California Health and Safety Code and California Water Code if <br /> existing, additional , or previously unidentified contamination at the site causes <br /> or threatens to cause pollution or nuisance or is found to pose a threat to <br />
