Section 25355.5 (a)(1)(C) <br /> 230 South Sterling Drive, Suite 246 <br /> Mountain House, California 95391 <br /> The California Department of Toxic Substances Control (DTSC) and Mountain <br /> House Developers, LLC (Shea Homes) (Proponent) enter into this Operation <br /> and Maintenance Agreement (Agreement) for the site located at 19855 West <br /> Grant Line Road, Mountain House, in the San Joaquin County, State of <br /> California, (Site) and agree as follows: <br /> This agreement is entered into to ensure that the remedy performed for the new <br /> Shea Homes residential subdivision at Mountain House will remain protective of <br /> human health and the environment. To proceed with residential use, sampling <br /> was conducted to throughout the proposed development. When levels of dieldrin <br /> were encountered that posed a risk above the levels set for cleanup, the soils <br /> contaminated with dieldrin were removed and placed in an internment cell. This <br /> internment cell lies wholly beneath Great Valley Parkway, and the internment <br /> cell's location under that roadway begins north of Great Valley Parkway's <br /> intersection with Grant Line road on the South and extends underneath Great <br /> Valley Parkway to the north until the internment cell ends before Great Valley <br /> Parkway intersects with Mascot Boulevard (AKA- Mustang Way)' as shown on <br /> San Joaquin Subdivision Map recorded as Tract No. 3649 as depicted on Sheet <br /> 5 of 27 (AKA 41-98D), and as specifically described and depicted on: sheet 18 of <br /> 27 (AKA 41-98% sheet 23 of 27 (AKA 41-98V), sheet 24 of 27 (AKA 41-98W), <br /> and sheet 25 of 27 (AKA 41-98X), with the roadway located west of adjacent <br /> Parcels O, N, M, and C as shown on sheet 5 of 27 (AKA 41-98D). <br /> 1. Jurisdiction. This Agreement is entered into by DTSC and Proponent <br /> pursuant to Health and Safety Code section 25355.5(a)(1)(C) which authorizes <br /> DTSC to enter into an enforceable agreement to oversee the investigation and/or <br /> remediation of a release or threatened release of any hazardous substance at or <br /> ' Mustang Way as depicted on SJ County APN Map 262-02 is the same street labeled Mascot Boulevard on <br /> Tract No.3649 sheet 3 of 27(AKA 41-98B)and Sheet 5 of 27(AKA 41-98D). <br /> I <br />
