' APPENDIX A STATEMENT OF LIMITATIONS ' The conclusions presented in this report are professional opinions based on data described in this report.These opinions have been arrived at in accordance with currently accepted hydrogeologic and engineering standards and practices applicable tothis location,and are subject to the following inherent limitations: 1. SECOR derived the data in this report primarily from visual inspections,examination of records in the public domain, and interviews with individuals having information about the site. The passage of ' time,manifestation of latent conditions,or occurrence of future events may require further study at the site,analysis of the data,and reevaluation of the findings,observations,and conclusions in the report. 2. The data reported and the findings,observations,and conclusions expressed in the report are limited ' by the scope of work. The scope of work was prescribed,in part,by ASTM Practice E 1527-00 and The Goodyear Tire and Rubber Company Combined Phase I and Phase II Environmental Site ' Assessment Specification,dated September 28,2001. The scope of work was agreed to by the client. 3. No warranty or guarantee,whether express or implied, is made with respect to the data reported of findings,observations,and conclusions that are based solely upon site conditions in existence at the ' time of the investigation. 4. SECOR Phase I and Limited Subsurface Investigation (Phase U) report (the report) present ' professional opinions and findings of a scientific and technical nature. The report shall not be construed to offer legal opinion or representations as to the requirements of, nor compliance with, environmental laws, rules,regulations, or policies of federal,state,or local governmental agencies. ' Any use of the report constitutes acceptance of the limits of SECOR's liability. SECOR's liability extends only to its client and not to any other parties who may obtain the report. ' 5. The conclusions presented in this report are professional opinions based on data described in this report. They are intended only for the purpose,site location,and project indicated. This report is not a definitive study of contamination at the site and should not be interpreted as such. No sampling or ' chemical analyses of structural materials or other media was completed as part of this study unless explicitly stated. ' 6. This report is based, in part,on unverified information supplied to SECOR by third-party sources. While efforts have been made to substantiate this third-party information,SECOR cannot guarantee its completeness or accuracy. 1
