This provision applies only to those liens <br /> for labor,material,and supply costs for the performance of the Activities on the property. <br /> 2.4 Prior to installing any monitoring points on the property, Grantee or its contractor will <br /> contact the appropriate local utility companies and request information about the location of the utility lines <br /> near the proposed work areas. Grantor will provide Grantee with any information in its possession about <br /> the location of any utility lines and any other underground lines, piping systems, tanks, or any other <br /> equipment or systems installed below ground on the property. <br /> 2.5 Grantee will obtain Grantor's approval of the location of the proposed <br /> Borehole/Monitoring Well prior to any drilling activities. Once the well is no longer required,Grantee will <br /> remove the Well and restore the surface areas of the Property disturbed by their removal. <br /> 2.6 If the surface of the Property or any improvements thereon shall be disturbed by the <br /> Work, then,upon completion of Work, the surface or improvements shall be promptly restored by Grantee <br /> to its condition just prior to such disturbance. <br /> 2.7 Grantee shall mail Grantor a copy of any reports that include the analytical testing results <br /> of the Activities (and of Grantee's environmental investigation of the facility) within two business days <br /> after Grantee submits the report to the regulatory authorities.' <br /> 2.8 Except for the approximately one day-long period (approximately 12 hrs) during which <br /> the Grantee and its contractors drill and install the monitoring point while the Grantee is performing <br /> activities on the property, Grantee will not block any driveways, entrances, or exits on the Property and <br /> Grantee will minimize its interference with the operation of the businesses on the Property to the extent <br /> practicable. <br /> 2.9 Grantee is permitted to install the monitoring point on the property only during the hours <br /> Of (a;aa ,Ao- through 3 :oa e"I on the following day(s) of the week: <br /> 1 ter'a4.� ; provided, however that Grantee is permitted to obtain samples from the <br /> monitoring points and perform any other aspects of the work at any time, including this specified <br /> installation time period. <br /> 2.10 Grantee shall, after the Borehole or Well is no longer useful to the investigation, backfill <br /> or close out such Borehole or Well according to applicable standards. <br /> 2.11 Grantee shall indemnify, defend, and save Grantor harmless from all liability, damage, <br /> expense, causes of action, suits, claims or judgments, including reasonable attorneys fees, resulting from <br /> injuries to persons or damage to property on the Property or on adjoining streets and sidewalks which arise <br /> out of the negligence of Grantee, its agents, employees, invitees, or guests in performing the Work under <br /> this Agreement. <br /> 2.12 This Agreement shall terminate upon the completion of the Work and the backfilling or <br /> closing out of Borehole or Well as provided herein. <br /> 2.13 Grantee shall use its best efforts to locate the Borehole or Well in a manner so as not to <br /> unreasonably interfere with Grantor's use and occupation of the Property. Grantor, its employees, invitees <br /> and authorized representatives shall not unreasonably interfere or tamper with the Well, Borehole and <br /> Grantee's performance of the Work, and furthermore, shall exercise reasonable care with regard to the <br /> Well,Borehole and Grantee's performance of the Work. <br /> 2.14 This Agreement shall only be assigned upon the prior written consent of both parties <br /> hereto. Furthermore, this Agreement shall bind and inure to the benefit of successors and assigns of the <br /> parties hereto. <br />
