SITE ACC:EMS AGREEMENT <br /> This Agreement is entered into as of the I3 day of Lurie , 2001, between Ouik Std <br /> Msrkets_Inc. ("Permitee")and Gil 3Yjamd(the"P[wertv <br /> Recitals <br /> A. The Property Owner owns certain real property comnwnly known as Burger King <br /> located at 3333 W.Hammer Lane, Stockton, CA(the"property"), <br /> B. Permitee is investigating possible soil and Vviadwater contamination related to a Fuel <br /> Leak Investigation at Quik Stop No. 13% 3555 W. Rammcr Lane, Stockton, CA This <br /> investigation is being performed under the direction of the San Joaquin County Public <br /> Health Services. <br /> C. Permitee wishes to conduct environmental sampling and testing on the Property to assist <br /> in this investigation. <br /> NOW THEREFORE, in consideratm of the mutual covenants contained herein, it is hereby <br /> agreed as follows: <br /> L Cl -of Liceass, S*ea to the terms and conditions of this Agreenmt, the Property <br /> owner hereby grants Permitee a license to enter the property for the limited purpose of <br /> observing the site and taking environmental samples. <br /> 2. Limitation on Use <br /> (a) Prior to cacI entry onto the Property, Permitee shall provide forty­cight (48) hours. <br /> notice to the Property Owaa, arrange for access, and, if requested by Property: <br /> Owner, allow oversight of all on-site activities. <br /> (b) Permitee shall ensure that none of its activities on the Property unreasonably intatere <br /> with or delay any other activities that are bang undertrken an the Property_ The <br /> Permit= shall at its sole cost and expense, repair, replace, or otherwise correct any <br /> and all damages unreasonably caused to the Propeaty, including the backfihits of i <br /> borings, and leave the Property in the same condition as prior to commencement of <br /> the site investigation. <br /> 3. Tptlg. The term of this Agreement shall commence on the date of execution of this <br /> Agreement and shall continue thereafter until Permitee has completed its investigation of <br /> possible groundwater contamination or until July 2006, whichever is sooner, provided, <br /> however, that with the mutual consent of both parties, this term may be extended as <br /> necessary to accommodate further investigation. <br /> xe�pc�cncszavae i <br />
