Permitee is iavestigating possible soil and groundwater eomaznination related to a Fuel Leak Investigation at Quik Stop No. 132, 3555 W. Hammer Lane, Stockton, CA This investigations being performed under the direo= of the San Joaquin County Public Health Services. C. permitee wishes to conduct environmental sampling and testing on the Property to assist in this investigation. NOW THIORE, in consideration of the mutual covenants contained herein, it is hereby agreed as follows: 1_ [,rarrr'of License. Subject to the terms and conditions of this Agreement, the Property owner hereby grants Permitee a license to enter the property for the limited purpose of observing the site and taking environmemal samples. 2. Limitation on Use. (a) Prior to each entry onto the Property, Permitee shall provide forty-eight (48) hours notice to the property Owner, arrange for access, and, if requested by Property: owner, allow oversight of all on-site activities. (b) Permitee shall ensure that none of its activities on the Property unreasonably inta'fere with or delay nay other activities that are being undertaken on the Property_ The Perm4Ce shall at its sole cost and expense, repair, replace, or otherwise correct any and all damages unreasonably caused to the Property, including the backfftg of borings, and leave t6-- Property in the same condition as prior to commencement of the site investigation. 3. Imo. :The term of this Agreement shall commence on the date of execution of this Agreement and shall continue thereafter until Permitee has completed its investigation of possible groundwater conaaminadon or until July 2006, whichever is sooner, provided, . however, that with the r>mtual consent of both parties, this term may be extended as necessary to accommodate further investigation.
