Ms. Wendy Wyels
Re: Koppel Stockton Terminal
May 2, 1995
Page 3
1992, Cargill terminated its lease. The NOV issued in 1992 was directed to the
contractor who was cleaning the building between tenants. It was not issued
to the Trust.
In 1992, Spreckels Sugar commenced operating the terminal for the
storage of sugar. Spreckels remains the tenant on the Site.
The Trust never operated the Site and could not have impacted the
groundwater. According to the State Water Resources Control Board policies,
the RWQCB should be looking to the truly responsible party -- the owner and
operator at the time of the discharge -- as the primarily responsible party. The
subsequent or "innocent" landowner shall only be held secondarily liable.
Vallco Park, No. 86-18.
Neither Munco nor the Trust are primarily responsible parties;
nonetheless, Munco is willing to conduct the limited soil investigation
proposed above. Any and all further requests or orders from the RWQCB
should be directed to the former owner and operator of the Koppel. You may
find his name and address on attachment "C". The former owner and
operator should be named as the primarily responsible party and only in the
event that the principal parties default on their responsibilities should the
RWQCB look to the secondarily responsible parties.
I want to let you know that there have been a few changes regarding
the personnel assisting on this site. First, Paul Sundberg is no longer with
Weston. Dave Marks, whom I believe you met in March, will be the contact
person at Weston. Second, I have changed offices and am no longer with the
firm of Neumiller & Beardslee. I am now with the law firm of McDonough,
Holland & Allen in Oakland. I have enclosed a copy of my business card for
you.
Allow me to reiterate Munco's desire to cooperate with the RWQCB.
Thank you for reviewing the attached workplan. We look forward to
obtaining your approval so that we may proceed with the investigation of the
