The NOV issued in 1992 was directed to the <br /> contractor who was cleaning the building between tenants. It was not issued <br /> to the Trust. <br /> In 1992, Spreckels Sugar commenced operating the terminal for the <br /> storage of sugar. Spreckels remains the tenant on the Site. <br /> The Trust never operated the Site and could not have impacted the <br /> groundwater. According to the State Water Resources Control Board policies, <br /> the RWQCB should be looking to the truly responsible party -- the owner and <br /> operator at the time of the discharge -- as the primarily responsible party. The <br /> subsequent or "innocent" landowner shall only be held secondarily liable. <br /> Vallco Park, No. 86-18. <br /> Neither Munco nor the Trust are primarily responsible parties; <br /> nonetheless, Munco is willing to conduct the limited soil investigation <br /> proposed above. Any and all further requests or orders from the RWQCB <br /> should be directed to the former owner and operator of the Koppel. You may <br /> find his name and address on attachment "C". The former owner and <br /> operator should be named as the primarily responsible party and only in the <br /> event that the principal parties default on their responsibilities should the <br /> RWQCB look to the secondarily responsible parties. <br /> I want to let you know that there have been a few changes regarding <br /> the personnel assisting on this site. First, Paul Sundberg is no longer with <br /> Weston. Dave Marks, whom I believe you met in March, will be the contact <br /> person at Weston. Second, I have changed offices and am no longer with the <br /> firm of Neumiller & Beardslee. I am now with the law firm of McDonough, <br /> Holland & Allen in Oakland.
