This does not indicate that there is an <br /> existing Eggiman,Andrew&Edith Trust, only that you own a rental building on Harding Way in Stockton. It <br /> appears that you inherited this property from the Trust after the tanks were removed in 1987. If the property <br /> and tanks were in the Trust prior to the UST removal in 1987 and the Trust has not been revoked,you can file <br /> a claim. However,the Trust must be named a responsible party,be directed to do the cleanup by San Joaquin <br /> County,and be incurring and paying the cleanup costs. If the claim is found to be eligible,we will require <br /> copies of canceled checks from the Trust as proof of payment of corrective action costs. The claimant,in its <br /> present form,must have owned or operated the tank(s)that leaked. <br /> You cannot use your social security number as the federal tax identification number for someone else's trust. <br /> Does the Eggiman,Andrew&Edith Trust still exist? If so,provide documentation and the correct federal tax <br /> identification number. <br /> Your application states the property owner,tank owner and tank operator is the Eggiman,Andrew&Edith <br /> Trust from 1979 until present. The tanks were removed in 1987 and not replaced so there has been no tank <br /> owner or operator since then. Documents submitted with the application indicate the tank owner and operator <br /> and the responsible party is Andrew Eggiman doing business as Eggiman Hydraulic Garage,not the Trust. <br /> The only eligible party to the Fund would be the tank owner or operator who has been named a responsible <br /> party and is incurring and paying the cleanup costs. <br /> Petroleum Underground Storage Tank Cleanup Fund Regulations §2810.1(a)states: <br /> "Only a current or former owner or operator of an underground storage tank or residential tank who <br /> has paid or will pay for the costs being claimed may file a claim against the Fund." <br /> NOTE: Failure to respond to this request within thirty(30)calendar days from the date of this letter may <br /> result in an ineligibility detennination of your claim. <br /> Caiiforma En viroame u&1 Protection A,geacy <br /> i``a Recyc%dPoper <br />
