The proposed budget and associated scope of work were
reviewed for general compliance with the "reasonable and necessary' requirement of
Section 2808.2(b)(1) of the UST Cleanup Fund regulations, Chapter 18,Title 23, CCR.
In addition, the Fund's 5-Year Review Unit recommended that your site be considered
for closure in a "USTCF 5-YEAR REVIEW SUMMARY" dated June 1 , 2009. If you
have not already done so, we recommend you and your consultant assemble a
comprehensive closure request package for submission to your lead regulatory
agency. An example `Table of Contents' for a closure request can be found attached
to this letter. If your closure request is denied by the lead regulatory agency, you may,
petition the State 'Water Board for case closure. For more information about how to file
a closure petition or other UST related petition, go to the UST Program website;
http:l/www.waterboards.ca.gov/water issues/programs/usticleanuplPetitions shtml
Please note, the Fund's closure recommendation is based on the provisions that the
potential for soil vapor migration is assessed and determined safe for prescribed site
activities, public participation and fee title notifications are conducted, and the
monitoring wells are appropriately abandoned.
For the most recent update on the availability of funding, please refer to the Fund's
web page: http://www.waterboards.ca:gov/water issues/programslustcf/.
If you would like to submit a Pre-Approval request for preparation of your closure
request report or related activities, please go to the Fuad website for the Pre-Approval
request form and instructions.
hftp://www.waterboards,ca.ciov/water issues/programs/ustcf/docs/cost preapproval/co
stpreapproval.pdf
Califoruis Environmental Protection Agency
Recycled Psper
