GP-88-22 ,
ZR-89-26 , AND SU-89-25 OF THE FREMONT
INDUSTRIAL ASSOCIATES (C/O JOSE ALVA )
-------------------------------------------------------------------
Based on the significant adverse environmental impacts detailed in
the attached Initial Study, the preparation of an Environmental
Impact Report is being required for the proposed project. A letter
detailing the requirements in order to proceed with the Notice of
Preparation and Request for Proposal will be distributed to the
project sponsors at the Development Committee meeting scheduled for
June 29 , 1989 .
MAJOR SUBDIVISION :
The Permit Streamlining Act requires that action be taken on the
Major Subdivision Application within one year of its being deemed
complete (per Section 65950 , California Government Code ) . These
applications were deemed complete on June 2 , 1989 , and the one-year
period will expire on June 2 , 1990 . Since there will be an EIR
prepared for this project, and the EIR may suggest several mitiga-
tion measures that will be needed to be incorporated in a revised
tentative map, it may not be possible to get the Major Subdivision
Application to public hearing within the one-year period. Because
of this potential timing problem , staff is recommending that the
Major Subdivision Application be withdrawn under Section 9-10509 of
the Planning Title , which will prevent the loss of the subdivision
filing fee , and allows the subdivision application to be refiled at
any time within one year of the withdrawal date , with no additional
fees collected.
