Weber Street, 3rd Floor Stockton, CA 95202 Subject: Request for Revised Schedule for Tosco (Former BP) Service Station No. 11195, 16500 South Interstate 5,Lathrop, California. Dear Mr.Infurna: At the request of Tosco Corporation, a subsidiary of Phillips Petroleum Company.(Tosco), Gettler-Ryan Inc. (GR) has prepared this letter requesting an extension of the deadlines listed in our letter to the San Joaquin County Public Health Services — Environmental Health Division (PHS-EHD) dated November 28. 2002. As of this date, Tosco has only one of two required access agreements necessary to complete the scope of work proposed in GR's Work Plan for Limited Subsurface Investigation, dated October 15, 2001, As per my telephone message on January 15,2002, GR's ability to schedule the drilling activities is dependent on receiving access agreements with the offsite property owners. Tosco has reached .r an access agreement with Holiday Inn Express, the owners of Assessor's Parcel number 198-210- 02 which is southeast of the subject site. However the owners of the vacant lot south of subject site, Creek LLC Signs and Leased Buildings, has not agreed to allow Tosco access to their property after two requests (initial and follow-up, per our November 28, 2001 letter). In fact, Creek LLC did not respond to either of the two requests. Therefore, Tosco and GR are requesting the PHD-EHD assist in obtaining access to the Creek LLC parcel (APN: 1.98-210-23) south of the subject site. Enclosed is a copy of the letter and Off- site Property Owner Data,Sheet containing contact information for the appropriate property owners. GR.intends to complete the proposed scope of work during one mobilization to the site. Fieldworl< will be scheduled after the anticipated receipt of the second access agreeirtent. After drilling, the sample analytical results will be received in approximately two weeks. Only.after these results are received can the GR staff analyze the data and prepare a technical report. Therefore, GR is proposing the following revised deadlines to supercede those contained in our letter dated November'28, 2001: • February 15, 2002 -receive access agreements • March_ 1,2002 -install five Geoprobes • April 12, 2002 -submit Technical Report with conclusions and recommendations Please be advised that the proposed deadlines are contingent upon Tosco negotiating access agreements with both offsite property owners. 6747 Siteorgaat Court , Suite J Dublin , California 94568 ( 925 } 551 -7555
