Weber Street, 3rd Floor <br /> Stockton, CA 95202 <br /> Subject: Request for Revised Schedule for Tosco (Former BP) Service Station No. <br /> 11195, 16500 South Interstate 5,Lathrop, California. <br /> Dear Mr.Infurna: <br /> At the request of Tosco Corporation, a subsidiary of Phillips Petroleum Company.(Tosco), <br /> Gettler-Ryan Inc. (GR) has prepared this letter requesting an extension of the deadlines listed in <br /> our letter to the San Joaquin County Public Health Services — Environmental Health Division <br /> (PHS-EHD) dated November 28. 2002. As of this date, Tosco has only one of two required <br /> access agreements necessary to complete the scope of work proposed in GR's Work Plan for <br /> Limited Subsurface Investigation, dated October 15, 2001, <br /> As per my telephone message on January 15,2002, GR's ability to schedule the drilling activities <br /> is dependent on receiving access agreements with the offsite property owners. Tosco has reached <br /> .r an access agreement with Holiday Inn Express, the owners of Assessor's Parcel number 198-210- <br /> 02 which is southeast of the subject site. However the owners of the vacant lot south of subject <br /> site, Creek LLC Signs and Leased Buildings, has not agreed to allow Tosco access to their <br /> property after two requests (initial and follow-up, per our November 28, 2001 letter). In fact, <br /> Creek LLC did not respond to either of the two requests. <br /> Therefore, Tosco and GR are requesting the PHD-EHD assist in obtaining access to the Creek <br /> LLC parcel (APN: 1.98-210-23) south of the subject site. Enclosed is a copy of the letter and Off- <br /> site Property Owner Data,Sheet containing contact information for the appropriate property <br /> owners. <br /> GR.intends to complete the proposed scope of work during one mobilization to the site. <br /> Fieldworl< will be scheduled after the anticipated receipt of the second access agreeirtent. After <br /> drilling, the sample analytical results will be received in approximately two weeks. Only.after <br /> these results are received can the GR staff analyze the data and prepare a technical report. <br /> Therefore, GR is proposing the following revised deadlines to supercede those contained in our <br /> letter dated November'28, 2001: <br /> • February 15, 2002 -receive access agreements <br /> • March_ 1,2002 -install five Geoprobes <br /> • April 12, 2002 -submit Technical Report with conclusions and recommendations <br /> Please be advised that the proposed deadlines are contingent upon Tosco negotiating access <br /> agreements with both offsite property owners. <br /> 6747 Siteorgaat Court , Suite J Dublin , California 94568 ( 925 } 551 -7555 <br />
