' Nest/6 USA, Inc.—Rip*CA October 31, 2006 <br /> Public Participation Plan <br /> 1 INTRODUCTION <br /> This Public Participation Plan (PPP) has been developed under Cleanup and Abatement <br /> Order#R5-2006-1720 (CAO) by Environmental Cost Management, Inc. (ECM) at the <br /> request of Nestle USA, Inc. (Nestle). This PPP is consistent with Public Participation <br /> t Plans, Regional Board Preparation and Implementation Guidelines, North Coast <br /> Regional Water Quality Control Board, April 2000. <br /> 1.1 PURPOSE <br /> ' The purpose of this PPP is to solicit comments from the public, address concerns, and <br /> disseminate information regarding the investigation and proposed cleanup activities at or <br /> near the vicinity of a former Nestle facility in Ripon, California. <br /> To this end the Plan proposes to: <br /> • Involve the public in the implementation and development of the Project as <br /> ' described below <br /> • Inform the public about the objectives of the investigation and cleanup activities, <br /> and <br /> ' • Update the public about the cleanup process and goals for the Project. <br /> The PPP will be updated as necessary to reflect any significant changes in public <br /> ' interest or involvement as the investigation and cleanup processes moves forward. <br /> ' 1.2 PROJECT BACKGROUND <br /> Nestle operated a beverage manufacturing facility at 230 Industrial Avenue in Ripon, <br /> California, from 1930 through 1994. The facility ceased manufacturing in 1994. <br /> ' The RWQCB has identified Nestle as a discharger of trichloroethylene (TCE) into the <br /> groundwater and has ordered Nestle to continue investigation and remediation work. <br /> Other parties may also be responsible for the impacted groundwater. <br /> Nestle has investigated the status of the groundwater in the past and is continuing its <br /> long-term investigation and cleanup activities in the vicinity of the former Facility. All of <br /> these efforts together are referred to below as "the Project". <br /> ' 1.3 REGULATORY AGENCIES <br /> The RWQCB has direct oversight of this Project and acts as the lead agency. The San <br /> Joaquin County Environmental Health Department, the San Joaquin County Unified Air <br /> Pollution Control District and the Stanislaus County Department of Environmental <br /> Resources are other regulatory agencies that are involved in several other aspects of <br /> ' the Project, including issuing any permits that may be required for this Project. <br /> 1 <br />
