ATTACHMENT 1 <br /> OTHER ISSUES DISCUSSED AT 25 APRIL 1991 MEETING <br /> 1 . Dr. Lee Schull of Western Environmental Health discussed the proposed <br /> methodology to determine the cleanup levels. The two major issues in <br /> determining cleanup levels are the significance of Maximum Contaminant <br /> Levels (MCLS) and the additive effects due to multiple volatile organic <br /> constituents (VOCs) . Contaminants are placed into one of three groups (A, <br /> B and C) based on the cancer risks developed from available testing data. <br /> Dr. Jon Marshack indicated that a cancer risk of 10-6 should be used for <br /> both Group A and B contaminants because the receptor is the ground water. <br /> This cancer risk for both groups is consistent with the health advisory <br /> published by the Environmental Protection Agency (EPA) and the State <br /> Action Levels (SALs) estabiished by the Department of Health Services <br /> (DHS) . Both Nestle and the Regional Board are willing to reevaluate <br /> cleanup levels as cleanup continues with a five year review period. <br /> 2. Nestle discussed the status of the off-site soil vacuuming system in the <br /> area of M-8. Start-up of the system should begin in August 1991 . Nestle <br /> has used a mobile system for the on-site vacuum extraction system. Nestle <br /> will consider pulsing to improve the efficiency of the system. <br /> Chloroform concentrations in the soil and ground water samples from VE-5, <br /> near the paint shed, have been reduced dramatically due to the vacuum <br /> extraction system. Chloroform concentrations in the soil were at about <br /> 30,000 milligrams per liter (mg/1 ) and are now less than 10 (mg/1 ) . The <br /> concentrations of chloroform in the ground water in this area were at <br /> about 9000 micrograms per liter (pg/1 ) and have been reduced to less than <br /> 10 pg/l . <br /> 3. We informed Nestle that two legal firms had copied the case files. The <br /> law firm retained by Regal Almond is McCutchen, Doyle, Brown and Enerson. <br /> The legal firm in the Bartell versus Renfroe case is Strauss, Neibaur, <br /> Anderson and Ramirez. Because the latter firm had subpened the files, we <br /> made available the AB 1803 files and the historical case file. Nestle <br /> will make arrangements to make copies of these files. <br /> 4. Nestle is one of the sites selected for the Spills, Leaks, investigations <br /> and Cleanup (SLIC) program Cleanup and Abatement Account Pilot Program. <br /> Nestle is willing to pay for oversight costs. Monthly or quarterly bills <br /> and the daily logs will be sent directly to the facility. <br /> CKW:cw <br />
