BOX 60 <br /> Tracy, CA 95378 <br /> CLOSURE REQUEST AND DEED RESTRICTION— FORMER HOLLY SUGAR FACILITY, <br /> TRACY, SAN JOAQUIN COUNTY <br /> California Regional Water Quality Control Board, Central Valley Region (Central Valley Water <br /> Board) staff reviewed the 22 October 2009 AST Closure Request/Deed Restriction (Letter) <br /> submitted by John Minney on behalf of Spreckels Sugar Company (Spreckels) for the former <br /> Holly Sugar facility on Holly Drive in Tracy (Site). <br /> The Site is the location of a former sugar beet processing facility. In November 1990, about <br /> 500-to-800 gallons of No. 6 fuel oil spilled from a 420,000-gallon aboveground storage tank <br /> (AGT) in the northeast corner of the facility. Spreckels emptied the tank in 1997, and it is no <br /> longer in operation. <br /> The 28 September 2009 Central Valley Water Board staff letter (Board Staff Letter) concurred <br /> with closure of the Site if a land use covenant (deed restriction) is placed on a small section of <br /> the property to limit the installation of new domestic wells at the Site and it included a draft <br /> deed restriction for Spreckels to review. The Letter states that Spreckels would like to pursue <br /> this option, however it does not include any comments on the draft deed restriction, and it is <br /> not clear whether Spreckels has completed its review of this document. Therefore, by <br /> 14 December 2009, Spreckels needs to notify Central Valley Water Board staff whether it has <br /> reviewed the draft deed restriction and has any additional comments. <br /> The Board Staff Letter also notified Spreckels that the final deed restriction needs to include <br /> the legal property description for the area covered by the restriction. The Letter includes a <br /> map of the area to be covered in the deed restriction. This area corresponds to the entire <br /> groundwater plume plus an additional 200 feet in each direction. Spreckels calculated that the <br /> existing plume would not travel more than 200 feet prior to reaching the water quality <br /> objectives. Central Valley Water Board staff concurs with this map. By 14 December 2009, <br /> Spreckels needs to survey this area and send Central Valley Water Board staff the legal <br /> description for inclusion in the deed restriction. <br /> California Environmental Protection Agency <br /> :Ad Recycled Paper <br />
