Assessor's Parcel No.: APN 152-100-087 PERMIT TO ENTER FOR PRELIM)NARY ENGINEERING AND FIELD STUDIES FOR FOLSOM SOUTH CANAL CONNECTION PROJECT For a consideration of$100,permission is granted to Fast Bay Municipal Utility District("District")for a period between December 1, 1996 through December 31, 1997 to enter in,over and upon owner's land for the purposes of evaluating the resources present within the project area,including field studies of plants and wildlife species to determine possible impacts from project construction and operation. Studies will consist of wildlife surveys, plant studies, and archeological field studies, and preliminary engineering studies, including surveying, in connection with the District's Initial Study of the Folsom South Canal Connection Project- The rojectThe rights and privileges hereby granted to District may,at the option of the District, be exercised by any authorized agent or contractor of District, including but not limited to CH2M Hill, Jones & Stokes Associates,and their subconsulUnts- Even though this Permit does not require physical soil disturbance of Owner's land, it is understood and agreed that the District will leave the premises in a clean and orderly condition and will repair,replace, or compensate for any existing improvements that may have been unexpectedly or accidentally disturbed during the course of work- Project team members and the project consultant have been thoroughly instructed in proper field procedures and conduct. The following rules will be followed: • Property owners will be given at least 24 hours' notice by telephone or mail prior to entry.. • Gates will be left as they were found. • All vehicles will stay on roads-,no off-road vehicle travel will be permitted. No pets or firearms will be permitted. • All machinery and vehicles will be equipped with spark arrestors- All vehicles will be required to carry fire extinguishers and shovels. • Smoking is permitted only in enclosed vehicles. • No trash or other evidence of field visits will be left on the property. All field staff will carry identification and information regarding this project. • Vehicle speeds will be kept to five(5)miles per hour on unpaved roads in agricultural properties to minimize dust Owner is welcome to accompany or observe any of the crews working on their property at any time. District agrees to indemnify,defend,and hold the undersigned parties barmless from and against any and all loss, liability,expense,claims, costs,suits,damages(including punitive damages), and attorney's fees, arising directly out-of the District's negligent operation or performance under this permit.
