The FRP was requested by 1 October 2001. In our 22 October 2001 letter,we <br /> again requested you complete SVE testing and submit the delinquent FRP. We also requested you to submit a <br /> project schedule for completing the SVE testing and submitting a FRP. In your 30 October 2001 project schedule, <br /> you noted that the completion date for submitting a FRP was 22 February 2002. To date,the FRP has still not been <br /> submitted, and we have not received any correspondence from you or your consultant concerning this matter. <br /> San Joaquin County Environmental Health Department(County)referred this site to the Regional Water Board in <br /> August 2000 due to your non-compliance with the County's directives. We issued a California Water Code Section <br /> 13267 directive to you on 28 August 2000 requiring you to submit a plan of work to complete the soil and <br /> groundwater investigation relating to the former underground storage tanks(USTs)at the subject site. The initial <br /> workplan was submitted as required; however,you have not shown a good faith effort to continue this investigation <br /> and clean up. <br /> Based on your disregard for our requests,we find that you are out of compliance, and this letter will serve as your <br /> first Notice of Violation. We again request that you submit the delinquent FRP forthwith. Failure to comply with <br /> this request may subject you to formal enforcement actions including administrative civil liability(monetary fines), <br /> and may affect future reimbursements from the UST Cleanup Fund. By 15 April 2002, please acknowledge this <br /> letter by submitting a status report to notify us of your progress to complete SVE testing and submit the FRP. <br /> Please notify me at least five business days prior to any site work.
