To date, this workplan has not been received by County staff. <br /> Analytical results of tank pit samples, collected in March 1988 when the USTs were removed, show <br /> high concentrations of total petroleum hydrocarbons as diesel, toluene, and xylenes. Based on this <br /> information, an investigation is required to identify the extent and concentration of soil and groundwater <br /> contamination at your site. <br /> By 2 October 2000, you must submit a workplan to this office describing your proposed plans to <br /> investigate the lateral and vertical extent of contamination at the subject site. All soil and groundwater <br /> samples must be analyzed for TPHd, TPHg, and BTEX, and for five fuel oxygenates, ethanol, methanol, <br /> 1,2-dichloroethane, and ethylene dibromide by EPA Method 8260B. <br /> The required"workplan" is a technical report as described in Section 13267 of the California Water <br /> Code,which states, in part: <br /> "(b)(1)In conducting an investigation specified in subdivision (a), the regional board may <br /> require any person who has discharged, discharges, or is suspected of discharging, or who proposes <br /> to discharge waste within its region...shall furnish, underpenalty ofperjury, technical or monitoring <br /> reports which the regional board requires. The burden, including costs, of these reports shall bear a <br /> reasonable relationship to the need for the report and the benefits to be obtained from the reports. " <br /> Failure to submit the requested technical reports could lead to fines authorized by Section 13268 of the <br /> Water Code, which states: <br /> "(a)Any person failing or refusing to furnish technical or monitoring program reports as <br /> required by subdivision (b) of Section 13267...is guilty of a misdemeanor and may be liable civilly in <br /> accordance with subdivision (b). <br /> California Environmental Protection Agency <br /> O•a Recycled Paper <br />
