It is being proposed, therefore, that your claim be removed from the <br /> Priority List based on the following reason: <br /> Section 2811(b)(3) of the UST Cleanup Fund Regulations requires that you remain in <br /> compliance with corrective action directives issued by the local regulatory agency. On <br /> March 21, 2000, Fund staff completed a detailed review of your claim at the San Joaquin County <br /> Public Health Services, Environmental Health Division (PHS/EHD) and you were deemed out of <br /> compliance with their directives. On March 22, 2000, the Fund sent you a `90-day Compliance <br /> Letter.' The letter listed steps you must take to begin the necessary investigative work at your <br /> site in order to come into compliance and continue your eligibility for reimbursement of cleanup <br /> costs from the UST Cleanup Fund. The investigative work was never performed and on <br /> August 1, 2000, your case was referred to the Regional Water Quality Control Board for <br /> enforcement action. <br /> If you disagree with this Staff Decision, you may either request review and reconsideration by <br /> the Program Manager or you may formally appeal the decision and request a Division Decision <br /> from the Chief of the Division.
