PC : 9-17-87 <br /> MS-88-3 <br /> STAFF ANALYSIS <br /> BACKGROUND AND PROPERTY HISTORY: <br /> The proposal was processed as a Staff Review With Public Notice <br /> project . On August 13 , 1987 , the Planning Division approved <br /> Minor Subdivision Application No. MS-88-3 subject to conditions. <br /> Subsequently, on August 24 , 1987 , the staff ' decision to approve <br /> was appealed by several neighboring property owners (see the <br /> attached appeal ) . <br /> The Planning Commission approved a similar proposal on May 1 , <br /> 1986 (MS-86-60) . That decision was subsequently appealed to the <br /> Board of Supervisors, who ultimately granted the appeal (denied <br /> the project ) on June 30, 1986 . The original proposal was for two <br /> 1 . 0-acre parcels and a 45 + acre remainder. At the time of the <br /> original Planning Commission action, the Commission had granted <br /> only one homesite parcel as part of their action, rather than the <br /> two requested. <br /> The major issues of the original proposal centered on the facts <br /> that the applicant ' s proposal was an encroachment of a nonagri- <br /> cultural use into an agricultural area and that Mr. Jagir is a <br /> teacher and realtor . The appeal questioned his qualifications as <br /> an owner-operator of an agricultural enterprise as defined by the <br /> Planning Title. The same basic issues have again arisen on this <br /> latest proposal , which was submitted on July 6 , 1987 . <br /> Procedurally, Section 9-1113 of the Title prohibits a similar <br /> application within one year of the date of denial . <br /> FINDINGS <br /> 1 . "The proposed map is consistent with applicable General and <br /> Specific Plans as specified in Section 65451 of the <br /> Subdivision Map Act . " <br /> This finding can be made because the proposed division is <br /> consistent with the provisions of the GA zone, which is the <br /> primary zone consistent with the Agriculture designation. <br /> 2 . "The design or improvement of the proposed subdivision is <br /> consistent with applicable General and Specific Plans. " <br /> This finding can be made because the creation of homesites <br /> for persons engaged in agriculture creates incentives for <br /> the maintenance of agricultural operations, which is a goal <br /> of the General Plan. <br /> -10- <br />
