Market Street <br /> Stockton, CA 95202 <br /> Dear Orage: <br /> Enclosed are a letter and a technical memorandum which we received <br /> yesterday from the Regional Water Quality Control Board. Although <br /> at first reading they seem rather daunting, after conversations <br /> with Cori Condon and re-reading, the letters merely confirm what <br /> has been told to you from the beginning: the first level water <br /> table under the area is not in good condition. <br /> The letters do not mention soil contamination. The reason is, <br /> according to Ms. Condon, that the soils do not show any levels of <br /> contamination of concern to them. In fact, development on the site <br /> is not precluded - we would be happy to issue you a building permit <br /> - as long as access to adequate numbers and locations of monitoring <br /> wells can be ensured. <br /> Of concern to us is the fact that many of the State' s issues relate <br /> to initial tests which were done in 1989 . These tests were one- <br /> time only, not confirmed, and resulted in further investigation by <br /> our environmental consultants. RESNA engineers have told us that <br /> they would not rely on the accuracy of those early tests based on <br /> one sampling round. The more recent testing has been carefully <br /> plotted and carefully conducted. In fact, we are right now <br /> preparing to re-sample to confirm our more recent results . <br /> ,V <br /> We are pleased that the sails have proven not to be a problem, and <br /> that availability for development is immediate. Since your concern <br /> was with the soils, I assume we can begin immediately to conclude <br /> our negotiations on the site. Please let me know what Time will be <br /> convenient for you and your team. <br /> Ms. Condon reiterated her confidence in our consultants, saying, <br /> "They know what they' re doing. " We will continue to work closely <br /> with them to address the remaining issues. The resolution of the <br /> remaining issues related to water quality will be undertaken and <br /> dealt with as expeditiously as possible.
