A consistent, written <br />process is used to respond to and investigate complaints that fall under the jurisdictional authority of the EHD. All <br />complaints made to the EHD are alleged and not considered to be valid unless verified by an inspection and/or <br />investigation by EHD staff. Unless exempted for other reasons, the nature of the complaint and any official <br />inspection reports or notices issued in response to a complaint are public record. However, in accordance with EHD <br />policy and section 6254(k) of the Government Code, complainant information is confidential and exempt from <br />disclosure. Nevertheless, related EHD employees can be subpoenaed to testify regarding the contents of <br />confidential complaint records. <br />With respect to your requests, three complaints (complaint numbers C00001081, C0006548 and C00020723) were <br />found regarding the site location known as 4911 Buckley Cove Way, Stockton. The EHD also maintains a small <br />hazardous waste generator file for this location. However, after confirmation with the San Joaquin County District <br />Attorney's Office and pursuant to section 6254(f) of the Government Code, these complaints and the small <br />hazardous waste generator file are exempt from release at this time. The EHD is currently involved in an active, <br />ongoing investigation and the disclosure of the information may endanger the successful completion of the <br />investigation. These records will be made available for public inspection upon successful completion of the <br />investigation. <br />For your information, the EHD also maintains a facility file for the retail food facility at the site. Although not <br />specifically identified in your requests, this file is available for inspection at this time.
