1.4 Purpose. The purpose of this Agreement is for the Proponent to submit a <br />Preliminary Endangerment Assessment (PEA) Equivalent Report summarizing completion <br />of the characterization and soil removal activities conducted at the Site. DTSC will <br />determine based upon review of the PEA Equivalent Report if a No Further Action finding is <br />appropriate for the area of the site investigated and subject to soil removal activities. The <br />purpose of this Agreement is also for DTSC to obtain reimbursement from the Proponent <br />for DTSC's oversight costs. DTSC will be working in coordination with the San Joaquin <br />County Environmental Health Department (SJCEHD) and Regional Water Quality Control <br />Board (RWQCB) as needed during the proposed scope of work in this Agreement. <br />II. BACKGROUND <br />2.1 Ownership. The property subject to this Agreement is owned by the City of <br />Stockton's Parks and Recreation Department and operated by Ms. Patricia Bonnifield <br />doing business as Ladd's Stockton Marina, Inc. located at 4911 Buckley Cove Way, <br />Stockton, California 95219 (see Exhibit B). <br />2.2 Substances Found at the Site. A soil sample collected by San Joaquin <br />County Environmental Health personnel on May 12, 2003, identified the metal Copper at <br />10,200 mg/kg through laboratory analysis. <br />2.3 Physical Description. The Site is generally flat, located in a slight depression <br />that is bordered by Buckley Cove North on the north and Buckley Cove South on the south. <br />2.4 Site History. The San Joaquin County Environmental Health Department <br />conducted an inspection of the Ladd's Stockton Marina, Inc on May 12, 2003. Soil <br />samples collected during this inspection identified elevated levels of the metal Copper. <br />III. AGREEMENT <br />3.0 IT IS HEREBY AGREED THAT DTSC will provide review and oversight of <br />the response activities conducted by the Proponent in accordance with the Scope of Work <br />2 <br />
