Apparently there was no further contact with the county and it appears that you went
forward with a workplan. EHD cannot accept results from sampling which was not witnessed by
EHD or DTSC.
Thus, the cleanup portion of this matter still remains to be resolved. To do this, the
following steps need to be taken: a sampling plan needs to be submitted to either EHD or DTSC
with accurate sampling locations and background sample locations shown; sampling must be
witnesses by either EHD or DTSC with 48 hours notice provided prior to the sampling event and
sampling results must be submitted for DTSC for review and sign off that no further action is
required.
I am informed by Ms. Foley that she and Mr. Cargile agreed that this service could be
provided at minimal cost.
As you were informed at the time of the meeting with this office, EHD does not normally
approve workplans except for the removal of gross contamination.
I wish to inform you that resolution of this workplan issue still leaves any past disposal
questions to be resolved. Please understand that we are not commenting on any possible air
pollution or OSHA issues in connection with this site, only with matters of hazardous waste and
water pollution.
Thank you for your courtesy and cooperation in this matter.
Very truly yours,
OFFICE OF THE DISTRICT ATTORNEY
"N'C
Peter C.
