Health & Safety Code (HSC) 25189.5(a) The disposal of any hazardous waste, or the causing <br />thereof, is prohibited when the disposal is at a facility which does not have a permit from the <br />department issued pursuant to this chapter, or at any point which is not authorized according to <br />this chapter. <br />->Disposed of waste contaminated with hazardous levels of copper to the ground. <br />California Code of Regulations (CCR), Title 22, 66262.11 person who generates a waste, as <br />defined in section 66261 2, shall determine if that waste is a hazardous waste..... <br />->Failed to determine if the sandblast waste is a hazardous waste. <br />CCR, Title 22, 66262.34(f)(3) Each container and tank used for onsite accumulation of <br />hazardous waste shall be labeled or marked clearly with the words, "Hazardous Waste." <br />Additionally, all containers and portable tanks shall be labeled with the following information.... <br />-> Failed to properly label containers of hazardous waste. <br />CCR, Title 22, 66265.173(a) A container holding hazardous waste shall always be closed during <br />transfer and storage, except when it is necessary to add or remove waste. <br />->Failed to keep containers of hazardous waste closed except when adding or removing <br />hazardous waste. <br />CCR, Title 22 66265.52 The contingency plan shall describe the actions facility personnel shall <br />take to comply with sections 66265-5 5.51 and 6 in response to fires, explosions, or any <br />unplanned sudden or non -sudden release of hazardous waste or hazardous waste constituents to <br />air, soil, or surface water at the facility. <br />->Contingency Plan is incomplete. <br />Attachment 1- EHD Inspection Report <br />Attachment 2- DTSC Inspection Report <br />Attachment 3- Soil Sample Results <br />Attachment 4- Memo faxed to Mr. Bonnifield <br />Attachment 5- Certification of Returned to Compliance <br />Attachment 6- Sandblast waste manifest <br />Attachment 7- EHD Narrative <br />n\x- � 03 <br />Michelle Le, Senior S Dat <br />
