TASK 13. Operation and Maintenance (O&M). The Agency will comply with, or arrange <br /> for compliance with, all operation and maintenance (O&M) requirements or other <br /> institutional control measures, in accordance with the final RAP or Cleanup Plan. The <br /> Agency shall designate in the final RAP or Cleanup Plan the parties that will enter into <br /> an O&M Agreement, or otherwise be responsible for compliance with all O&M <br /> requirements, prior to certification of the Property or group of Properties. Compliance <br /> with any applicable 0&M Agreement, and any land use covenant or other institutional <br /> control measures, must be included as a requirement for any new owner/lessee in a <br /> purchase and sale agreement for the Property or group of Properties. Any party that is <br /> responsible for O&M shall notify DTSC of any transfer of operation and maintenance <br /> responsibilities at least 30 days prior to such transfer. DTSC may, at its discretion, <br /> require the transferee to enter into a new O&M Agreement. <br /> TASK 14. Discontinuation of Cleanup Technology. Any cleanup technology employed <br /> in implementation of the final RAP or Cleanup Plan will be left in place and operated by <br /> the Agency, owner of the Property (or its successors), or such other party designated in <br /> the final RAP or Cleanup Plan until and except to the extent that DTSC authorizes the <br /> Agency, Property Owner or such other party designated in the final RAP or Cleanup <br /> Plan, in writing, of the ability to discontinue, move or modify some or all of the cleanup <br /> technology because the final remedial action has met the criteria specified in the final <br /> RAP or Cleanup Plan for its discontinuance, or because the modifications would better <br /> achieve the goals of the final RAP or Cleanup plan. <br /> 20 of 31 <br />
