Redevelopment Agency will promptly notify DTSC of any change in the identity of <br /> the Project Coordinator. All engineering and geological work shall be conducted in <br /> conformance with applicable state law, including but not limited to, Business and <br /> Professions Code sections 6735 and 7835. <br /> 9. Access. If DTSC determines access is necessary in order to perform any of the <br /> tasks contained in Exhibit C, the Redevelopment Agency will exercise its best <br /> efforts to provide access for DTSC and its representatives to the Property or group <br /> of Properties subject to the Oversight Agreement for which access is needed. In <br /> the event that such access is not provided, it is understood that the implementation <br /> of tasks identified in this agreement for the Property or group of Properties for <br /> which access cannot be obtained may not proceed. The Redevelopment Agency <br /> will also exercise its best efforts to provide access for DTSC and its <br /> representative's access and/or obtain access to any area beyond the boundaries <br /> of the Property or group of Properties subject to the Oversight Agreement to which <br /> access is necessary to implement the Oversight Agreement. To the extent such <br /> access is obtained by the Redevelopment Agency, such access will be provided to <br /> DTSC's employees, contractors, and consultants at all reasonable times. Nothing <br /> in this section is intended or shall be construed to limit in any way the right of entry <br /> or inspection that DTSC or any other agency may otherwise have by operation of <br /> any law. To the extent such access can be legally obtained by DTSC or the <br /> Redevelopment Agency, DTSC and its authorized representatives shall have the <br /> authority to enter and move freely about all of the property at each Property or <br /> group of Properties at all reasonable times for purposes including, but not limited <br /> to: inspecting records and operating logs, sampling activities, administering any <br /> other aspects of the Oversight Agreement relating to the Property or group of <br /> Properties, reviewing the progress of the Redevelopment Agency in carrying out <br /> the terms of the Oversight Agreement, conducting such tests as DTSC may <br /> determine are necessary, and verifying the data submitted to DTSC by the <br /> Redevelopment Agency. <br /> 10. Sampling, Data and Document Availability. The Redevelopment Agency will <br /> submit to DTSC a listing of all known reports in its possession, including sample <br /> analysis results, environmental assessment reports, and any other information in <br /> its possession pertinent to the hazardous substance and hazardous waste <br /> management and/or release, characterization and cleanup of a Property or group <br /> of Properties. The Redevelopment Agency will provide copies of any non- <br /> privileged reports or information requested by DTSC and will identify privileged or <br /> other confidential documents that the Redevelopment Agency is not providing. The <br /> Redevelopment Agency will also inform DTSC of any other reports and <br /> documents, the existence of which is known to the Redevelopment Agency but <br /> which are not in its possession, pertinent to the hazardous substance and <br /> hazardous waste management and/or release, characterization and cleanup of a <br /> Property or group of Properties, including the name of the document (if known) <br /> and the identity and address of the person/entity with possession of the document <br /> (if known). <br /> 25 of 31 <br />
