("'Texaco"), one
of numerous parties to litigation concerning this underground tank site. Pursuant to the
Order of U.S.:Magistrate Judge Gregory G.Hollows, Texaco;has taken the lead on behalf of
several litigants in seeking site closure from San Joaquin County. The Court has extended
the deadline for obtaining site closure until June 30. In our recent discussions;you stated that
the County will:close the site immediately following the satisfaction of certain conditions.
The purposes of this letter are (1)to confirm that those conditions will be satisfied, and(2)
request that the:County grant closure of this site prior to June 30.
The background on.this site, and the long road to site closure; is>recounted in.
my prior correspondence to you. In summary, the County's Technical Review. Committee:
voted to close the site on October 24, 1996. Following;the receipt of additional
comments bythe Regional Board, on April 7 the State Board again stated thavelosure is
appropriate In:a memo to the State Board dated April 30;the Regional Board indicated it
now concurred that the County, should close the site. However, the legional Board atated
that the existing monitoring wells at this;site should not be destroyed immediately(the usual
practice when a site is closed},but'instead should be maintained until it has been determined
.A T T 4 R N E Y' S A.T L A W Three EmbaM cera Center San Francisca Palo Alto
Sen pranciscrr, California '94111-4067 Los Angeles: Washington, D.C.
Tel.{415}$93-2000 Fax {415) 383-2288 San Jose Taipei
http:llwrww.mccutohen.corn Walnut Creek
