R is q understanding that you represent the FDIC regarding the above-referenced propetrty:.
Myclient, Dolores Staudenraus, has just received notification from the Department of Toxic
$ubsta n Cothat they are requiring remediation of contaminated,`soll az dgroriind water. A copy
of the November:4, 1996 letter is enclosed.for your convenience.
Section 19.(b).of the Purchase and Sale Agreement between Ms. Staudenraut and the FDIC
require the FDIC as seller,to continue remediation until the"appropriate governmental agency"
consented toclosure. As your can see from the enclosed letter,,the Cal/EPA is requiring investigation
and remediation of soil and ground water contaminants. Under the terms of the sales agreement,
your+client is required to do that work, and we expect the FDIC to fulfill that requirement.inasmuch
as closure of the site has not been i obtained by the "appropriate governmental agency".
Inasmuch as Cal/EPA requires a response to their letter by December 4, 1996, we would
request a prompt reply from you concerning their position in this regard.
VWy truly yours,
